Terms and licence

1. Who you are dealing with

The software is made and supported by Ball Tracer (support.balltracerplugin@gmail.com). Orders are sold by Paddle.com Market Ltd, the authorised reseller and merchant of record: your payment contract is with them, they handle payment, invoicing, sales tax and refunds, and their buyer terms also apply to the payment.

2. The licence you get

A non-exclusive, non-transferable licence to:

• Install and use Ball Tracer, in DaVinci Resolve Studio and in Adobe Premiere Pro, on as many computers at a time as your key allows: two computers for a licence bought here. Each program counts on its own: DaVinci Resolve and Premiere Pro on the same computer take one activation each.
• Use it for commercial work, including paid work.
• Keep using the version you have for as long as you like. The licence does not expire.

12 months of updates are included. After that, the version you have keeps working. Every version released in the 12 months after you buy is covered by your key. A later version, installed, marks every frame with the word TRIAL, as an unactivated copy does. No particular update, or number of updates, is promised.

• Keep a copy of your installer

  The account page always offers the newest version. To reinstall your version after your updates end, keep a copy of its installer.

• A key you were given

  Covered by these same terms, apart from the parts about payment and refunds.

3. What you may not do

• Share, resell, rent or publish your licence key.
• Distribute the plug-in or its installer, modified or not, or pass on a download link.
• Remove, disable or work around the licence check or the TRIAL mark.
• Reverse engineer, decompile or disassemble the software, except as far as the law where you live allows despite this clause. In the EU and the UK, your right to decompile for interoperability is not affected.

• Open-source components

  Ball Tracer includes open-source components, such as OpenCV, used under their own licences and listed on the open-source notices page. Nothing here limits what those licences allow.

4. Your account and the download

You need to be 18 or older to make an account or buy, or have a parent or guardian do it with you. Buying needs an account on this site. The licence is added to the account you are signed in to when you pay and belongs to it from then on. Your key is shown after paying, and the key and the installer stay on your account page. Paddle emails a receipt; the key is never sent by email.

• A payment that did not reach your account

  Write to support.balltracerplugin@gmail.com with the order reference from the receipt, and it is sorted out by hand.

• Before activation

  The installer is for licence holders only. Until a copy is activated with a valid key, it marks every frame it renders with the word TRIAL. Removing the mark any other way is not allowed.

5. Activation and your computer

Activating sends a one-way fingerprint of your computer and your key to the licence server so the activation can be counted (see the privacy policy). Deactivate before changing computers to release the activation.

• Refunds and charge-backs

  When a full refund is approved, or a payment is charged back, the key is revoked and the installer is removed from your account page. A revoked key can keep working offline for up to 30 days, because the licence is cached on your computer.

6. What is promised, and what is not

The software is provided as is. It is not promised to be free of faults, to work on every computer, or to succeed on every shot, which is why there is a 14-day refund with no reason needed (see the refund policy).

As far as the law allows, no liability is accepted for lost work, time or income, or any indirect loss. Where liability cannot be excluded, it is limited to what you paid for the licence. Nothing here limits liability for death, personal injury, fraud, or anything else that cannot lawfully be limited.

7. Ending the licence

The licence ends if you break section 3, and when your money is refunded or charged back. Then stop using the software and delete it. Sections 6, 7 and 8 still apply afterwards.

8. Changes, law and disputes

These terms may change for future purchases; the version in force when you bought governs your purchase, and this page shows when it last changed. The law and courts that apply: the laws of the U.S. state where the seller lives, and the courts of that state. Your own country's mandatory consumer protections still apply.

9. Trademarks

DaVinci Resolve and the DaVinci Resolve logo are trademarks of Blackmagic Design Pty Ltd. Windows is a trademark of the Microsoft group of companies. Mac and macOS are trademarks of Apple Inc., registered in the U.S. and other countries and regions. Adobe, Premiere Pro and the Premiere Pro logo are either registered trademarks or trademarks of Adobe in the United States and/or other countries. Other names are the trademarks of their owners. Ball Tracer is not affiliated with, endorsed by, or sponsored by any of these companies.
